The influence of mining law systems upon the development of world metallurgy: the view of a ural manufacturer

Abstract


The author focuses on the biggest miner of the Urals, duke S. S. Abamelek-Lazarev, whose views on resources management were discussed in Russian society at the turn of the 20th century. S. S. Abamelek-Lazarev opposed the mining freedom principle, which deprived landowners of their proprietary right to the mining land, and defended the then existing principle of accession, which stipulated that the landowner possessed the resources of his land. Using comparative and statistical research, the duke studied the mining laws of a number of countries, and drawing upon considerable statistics he revealed how laws influenced the development of mining and metallurgical industries; also, he studied Russia’s historical data and current law which enabled him to draw conclusions and make observations. The duke maintained that it was essential to improve Russian legislation in a way that would stimulate the development of mining without stripping landowners of their rights. He focused on the leading countries of the 19th century and their legislation (England and the US). His writings and activities, aimed at protecting large-scale Ural mining, were crucial for the preservation of the principle of accession until the nationalization of land in 1917.
